      Welcome to NidraLiving. These Terms of Service govern your use of nidraliving.com and any purchase you make from us. By accessing this website or placing an order, you agree to these terms. If you do not agree, please do not use the site.
      NidraLiving is a brand owned and operated by Monochrome, a sole proprietorship of Noufal Karinka Ppara, having its principal place of business at 200 B - 2BHK, Skywalk Tower Two TC One, Guruvayurappan College Road, Palazhi, Kozhikode, Kerala 673014, India, GSTIN 32JLXPK4659E1ZI.

      1. Eligibility
      You must be at least 18 years old and legally capable of entering into a contract under the Indian Contract Act, 1872 to purchase from us. If you are under 18, you may use the site only with the involvement of a parent or legal guardian.

      2. Your account
      You are responsible for the accuracy of the information you provide and for keeping your account credentials confidential. You agree to notify us immediately of any unauthorised use of your account. We may suspend or terminate any account that we reasonably believe is being used fraudulently or in breach of these terms.

      3. Products, descriptions and images
      We take care to describe our products accurately. However, product images are for illustration and actual colour, texture and finish may vary slightly due to photography, lighting and your screen settings. Minor variation in dimensions is normal for manufactured goods and is not a defect.
      We do not warrant that product descriptions, images or other content are entirely error free. Where an error is identified, we reserve the right to correct it and to cancel any order placed on the basis of that error, with a full refund.

      4. Pricing and payment
      
        All prices are in Indian Rupees and inclusive of applicable GST unless stated otherwise
        Prices, offers and promotions are subject to change without prior notice
        In the event of an obvious pricing error, we reserve the right to cancel the order and issue a full refund rather than honour the incorrect price
        We accept prepaid payments through our payment gateway partners, and Cash on Delivery where available
        Discount codes cannot be combined unless expressly stated, are single use per customer unless stated otherwise, and may be withdrawn at any time
      

      5. Order acceptance
      Your order is an offer to purchase. A confirmation email or SMS is an acknowledgement of receipt, not acceptance. The contract is formed only when we dispatch the product. We reserve the right to decline or cancel any order, in whole or in part, including where:
      
        The product is out of stock or has been discontinued
        There is a pricing or listing error
        The delivery address is not serviceable
        We reasonably suspect fraud, resale intent, bulk ordering for commercial resale, or abuse of promotions
        We are unable to verify a Cash on Delivery order after reasonable attempts
      

      6. Wellness products: important disclaimer
      Please read this section carefully.
      
        NidraLiving products are general wellness and lifestyle comfort products. They are not medicines, drugs or medical devices, and they are not registered or approved as such
        Our products are not intended to diagnose, treat, cure, mitigate or prevent any disease or medical condition, including but not limited to sleep apnoea, insomnia, chronic pain, spinal disorders or respiratory conditions
        Any reference to comfort, relaxation, posture support or rest describes the intended use of the product and is not a medical claim
        Individual experience varies. We make no guarantee of any specific outcome or result
        Consult a qualified medical practitioner before use if you are pregnant, have a diagnosed medical condition, have had recent surgery, use a pacemaker or other implanted device, have circulatory, respiratory, spinal or skin conditions, or are purchasing for a child or an elderly person with health concerns
        Discontinue use immediately and seek medical advice if you experience pain, discomfort, breathing difficulty, skin irritation or any adverse reaction
        Products such as mouth tape and anti-snoring aids should not be used by anyone with nasal obstruction, respiratory illness, or under the influence of alcohol or sedatives
        Follow all instructions and safety warnings supplied with the product
      
      NidraLiving and Monochrome accept no liability for any injury, aggravation of an existing condition or adverse effect arising from misuse of a product, use contrary to instructions, or use without appropriate medical advice.

      7. Reviews and user content
      By submitting a review, photograph, video or other content to us or to our social media channels, you grant Monochrome a non exclusive, royalty free, worldwide licence to use, reproduce and display that content for marketing purposes. You confirm that the content is your own, is truthful, and does not infringe anyone else's rights. We may remove content that is abusive, misleading, unlawful or irrelevant.

      8. Intellectual property
      All content on this website, including the NidraLiving name, logo, brand assets, product photography, copy, graphics and page design, is owned by or licensed to Monochrome and protected under Indian and international intellectual property law. You may not copy, reproduce, republish, distribute or use any of it for commercial purposes without our prior written permission.

      9. Acceptable use
      You agree not to use this website to transmit malicious code, attempt unauthorised access, scrape or harvest data, interfere with the site's operation, place fraudulent orders, or violate any applicable law.

      10. Third party links
      Our site may link to third party websites or services. We are not responsible for the content, policies or practices of those third parties, and you access them at your own risk.

      11. Limitation of liability
      To the maximum extent permitted by law, the total liability of Monochrome in connection with any order shall not exceed the amount you actually paid for that order. We are not liable for indirect, incidental, special or consequential losses, including loss of profit, loss of opportunity or loss of data. Nothing in these terms limits liability that cannot be limited under the Consumer Protection Act, 2019.

      12. Force majeure
      We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, epidemics, strikes, courier network failures, government action, civil unrest or internet outages.

      13. Indemnity
      You agree to indemnify and hold harmless Monochrome, its proprietor, employees and partners against any claim, loss or expense arising from your breach of these terms or your misuse of any product.

      14. Governing law and jurisdiction
      These terms are governed by the laws of India. Subject to the rights available to consumers under the Consumer Protection Act, 2019, the courts at Kozhikode, Kerala, India shall have exclusive jurisdiction over any dispute arising from these terms.

      15. Changes to these terms
      We may revise these terms at any time. The version published on this page at the time you place an order is the version that applies to that order. Continued use of the site after changes are posted constitutes acceptance.
